On April 20, 2011, the US Department of Defense (DOD) announced that high-value Guantanamo Bay detainee Abd al-Rahim al-Nashiri will be subject to capital charges and tried in a military court. Nashiri was charged under the Military Commission Act of 2009 for plotting the bombing of the USS Cole in 2000 that killed 17 men; the bombing of the MV Limburg in 2002; and a failed plot to attack an American warship, The Sullivans. In February 2012, al-Nashiri's case was central to a decision by US military tribunal Judge James Pohl that the content of attorney-client mail inspected at the Guantanamo Bay facilities is confidential and may not be released.
